Terms and Conditions
The Marsh Landing Master Association (“MLMA”) parks Osprey Park and Fletcher Park are for the benefit of the Members of MLMA (“Park(s)”). Certain amenities within the Parks including the dog park, pickleball courts and restrooms have regulated controlled access entry.

To utilize the Parks, Members are required to execute this Application and Waiver. Upon execution by the Member, this waiver governs the Member’s access and use of the Parks and amenities on the terms set forth below.

Please review and abide by the following:

• Regulated Access Upon full execution of this document, Member is authorized to gain access to the amenities. Access code cost is $5 each and shall not be transferred by the Member to any other party.
• Restroom Access Restroom Access App only does not grant access to gated amenities.
• Gated Amenity Age Restriction The dog park and pickleball courts are gated amenities. Applicant ensures that all persons under the age of 14 are always accompanied by an adult chaperone. Gated Amenity Access App will not be given to minors under the age of 14.
• Marsh Landing Rules MLMA rules are always applicable. Applicant agrees to abide by all rules.
• Clean Up Applicant agrees to pick up pet waste, equipment, property, and trash after every use.
• Incidents Applicant agrees to immediately report, in writing, to MLMA any unsafe condition in the Facilities. Applicant also agrees to provide MLMA with a written report of any injury occurring in or about the Facilities during the time Applicant is entitled to use the Facilities.
• Amenity Hours All areas of the Parks can only be used from Sunrise to Sunset.
• Guests The Parks and amenities are for use by Members and their registered guests. When using Pickleball courts, the maximum number of accompanied guests will be 3 people, which will be regulated by a reservation system.
• Access to Courts The Basketball courts are open on first come basis. The Pickleball courts can be accessed by Members via the app and court usage will be managed by a reservation system. Refer to Pickleball rules and policies for more information.
• Wet Conditions Applicant agrees to stay off Basketball courts and Pickleball courts during and after rainfall events. Courts may remain wet for 24 hours after rainfall.
• Unsupervised The applicant understands and agrees that the Parks, including Pickleball and Dog parks, are not monitored or supervised and therefore the Member agrees to utilize the Parks amenities at their own risk.

Applicant acknowledges the Parks are for the enjoyment and use of all residents.

Further, by using the Parks, the applicant accepts sole responsibility and liability for any minors or registered guests. Despite careful and proper preparation, there is still a serious risk associated with the Parks and amenities including:

• Dog attacks and dog bites.
• The inexperience, negligence, or irresponsibility of a person.
• Cardiac arrest, sprains, broken and/or fractured bones, and other medical injuries.
• Acts of God.
• Inclement weather.
• Slips and falls.
• Premises defects.
• Equipment failure.
• Failure in instruction/supervision.
• All other circumstances inherent to outdoor activities.

Please note that parking is limited, and vehicles may not be parked to obviously impede traffic or obstruct entrances or exits.

WAIVER

As consideration for the Member’s use the Parks and issuance of App Access, the undersigned Member, does, for and on behalf of Member, Member’s heirs, Member’s personal representatives and spouse, Member’s children, Member’s guests, Member’s employees, Member’s agents, and Member’s invitees (“Member Releasor”), waive and release Marsh Landing at Sawgrass Association, Inc., its employees, officers, board members, agents, licensees or representatives (“MLMA Releasees”) from any claim or loss (including personal injury and death) suffered by Member Releasor arising from Member Releasor’s use of the Parks.
